Sexual harassment is a form of sex discrimination, prohibited by federal, state, and local laws. There are two kinds of sexual harassment: quid pro quo sexual harassment and hostile environment sexual harassment. Both male and female employees are protected from sexual harassment, regardless of whether the harasser is the same or opposite sex (e.g. a man may be sexually harassed by another man)
Quid pro quo happens when an employer or supervisor demands sexual favors in exchange for promotions or other perks or threatens an employee for failure to comply with the sexual requests with demotion, termination or other threats.
Hostile environment sexual harassment is when the working environment is made hostile because of its sexual nature. Sexual harassment is actionable if it is severe or pervasive or occurs so frequently that the workplace becomes offensive or hostile. Some examples of sexual harassment are when a manager, co-worker, or a customer:
Touch an employee in inappropriate ways, including groping or deliberately brushing up against an employee.
Ask questions or comment about an employee's clothing, body, or sex life.
Tell offensive sexual jokes or make other sexually suggestive remarks even though the employee has objected.
Display magazines or pictures that are sexual in nature, circulate explicit or sexually suggestive emails, or watch sexual videos publicly on workplace computers.
